In the United States, we are fortunate to have strict guidelines for workplace safety. Employers are bound by law to provide a safe working environment for their employees in order to minimize the risks of accidents, injuries and fatalities. This is one of the most common reasons for drug and alcohol testing in the workplace.
Drug and alcohol abuse in our workplace is decreasing as employers develop and enforce workplace policies and regularly drug and alcohol test their employees. An educated employer with an effective drug and alcohol policy enables the employer to maintain effective control and the safety of their workforce.
Employers are liable for accidents caused by employees, especially when they do not have a Drug-Free Workplace policy in place. Policies and regular drug and alcohol testing are the employer’s best assurance they are maintaining a safe environment for their employees.
Marijuana in the Workplace is still a topic of question and concern. Employees who fall under Federal guidelines such as the Department of Transportation’s testing regulations are prohibited from using marijuana. Please note that marijuana remains a drug listed in Schedule I of the Controlled Substances Act. DOT OFFICE OF DRUG AND ALCOHOL POLICY AND COMPLIANCE NOTICE states the Department of Transportation’s Drug and Alcohol Testing Regulation – 49 CFR Part 40, at 40.151(e) – does not authorize “medical marijuana” under a state law to be a valid medical explanation for a transportation employee’s positive drug test result.
Employers not regulated by the Department of Transportation can protect themselves by prohibiting the use of marijuana in their policies.
